A TEENAGER who told a friend how he got a wealthy schoolgirl drunk to get her into bed has been cleared of rape.

The 16-year-old from Eltham, was said to have attacked the girl as she lay passed out in a stupor on his bed.

Toby Fitzgerald, prosecuting, told jurors the girl, also 16, was "insensible and not capable of giving consent" in the early hours of November 30, 2008.

But the boy was cleared of rape on Tuesday after insisting she was awake and consented to sex during his trial at Inner London Crown Court.

Jurors heard the pair were merry after a night out with friends, when she agreed to go to his home in Eltham, to wait for a minicab.

The girl admitted to enjoying a degree of intimacy with him but said she refused sex, before drinking from a bottle of rum he handed her.

She claimed she woke up shortly afterwards to find herself half naked on the bed and the teenager told her they had just had sex together.

The boy then e-mailed his friend telling him: "She wasn't up for having sex, but I'm good, I got the gin out."

When questioned by officers he said: "Is this about that girl? I've not done anything. I had sex with her, she was drunk and so was I. What's wrong with that?
